Process for US Background Checks
As of June 21, 2018, the Ontario Securities Commission (OSC) will commence a US Background Check procedure in partnership with Sterling Talent Solutions (Sterling), a provider of background screening products. This procedure will affect individual registration applications where an applicant has been resident in the United States (US) at any time in the last 10 years from the date of application.
In order to implement this procedure an individual applicant will be required to provide express consent to Sterling. While Form 33-109F4 Registration of Individuals and Review of Permitted Individuals provides consent for the OSC to collect personal information, including contacting “private bodies or agencies, individuals, corporations and other organizations for information” about an applicant, part of Sterling’s security and privacy policies require that all applicants provide an express consent directly to Sterling.
Applicants will receive an e-mail from Sterling within 48 hours of filing their application on the National Registration Database. This e-mail will contain a secure link to an intuitive and user-friendly on-line portal where the consent may be provided.
Applicants are not required to consent to a US Background Check, however not doing so may impact their ability to become registered in a timely manner, or in some cases, at all.
We are confident that this arrangement will assist us in conducting timely due diligence, thereby minimizing impact to registrants.
